On February 3, 2026, Congress passed H.R. 7148 – Consolidated Appropriations Act, 2026, extending key Medicare telehealth flexibilities through December 31, 2027. These provisions have been in effect under various federal waivers since 2020.
Medicare Telehealth Flexibilities Extended Through 12/31/2027
- Removal of geographic and originating site restrictions
Medicare beneficiaries may continue to receive telehealth services regardless of rural designation or originating site type (including the home). - Expanded list of eligible telehealth practitioners
Continued eligibility for additional provider types. - Delay of the in-person visit requirement for mental health services
The statutory requirement for an in-person visit prior to certain behavioral health telehealth services remains suspended. - Continuation of audio-only telehealth services
Audio-only modalities remain permissible for applicable services when clinically appropriate.
